What is conveyancing and why do I need a conveyancer?

Conveyancing is the legal process of transferring property ownership from one person to another. In NSW you can use a solicitor or a licensed conveyancer. They review the contract, order searches, manage settlement and lodge the transfer electronically, which must be done by a subscriber such as a solicitor or licensed conveyancer. How long does the conveyancing process take?

The contract of sale sets the settlement date, so the timeline depends on what the buyer and seller agree. It can also be affected by finance approval, property searches, special conditions and any legal issues that come up. We confirm the key dates with you at the start of the matter and keep you informed at each stage.

What happens during property settlement?

Property settlement is the final step, when ownership formally transfers. On settlement day we coordinate with the other party's representative and the lenders so that funds are exchanged, documents are lodged and the transfer is registered. Before settlement we check the adjustments and confirm the final inspection arrangements, then tell you when settlement is complete so the keys can be released.

What property searches do you conduct?

The contract comes with the title search, plan, drainage diagram and section 10.7 planning certificate. Depending on the property we may recommend further searches, such as council, water or strata searches, which can show easements, restrictions, zoning and outstanding rates.

Do you handle both buying and selling conveyancing?

How much does a conveyancer cost in Sydney?

Conveyancing fees in Sydney typically depend on whether you're buying or selling, whether the property is residential or commercial, and the complexity of the contract (off-the-plan, strata, leasehold, or commercial leases all add work). On top of professional fees, you'll pay disbursements such as title searches, the planning certificate and the electronic settlement (PEXA or Sympli) fee, plus government charges such as registration fees and, for buyers, transfer duty. What government fees and disbursements should I budget for in NSW?

Budget for NSW transfer (stamp) duty (calculated on the higher of the purchase price and the market value, with concessions for eligible first home buyers), Land Registry Services lodgment fees, title search and planning certificate fees, council and water authority searches, and the electronic settlement fee charged by PEXA or Sympli. First home buyers may also qualify for the First Home Buyers Assistance Scheme. We itemise every cost in your written quote.

Do I need a solicitor or conveyancer to buy a house in NSW?

You can use either. NSW Government guidance says solicitors and licensed conveyancers are equally qualified to do conveyancing. A licensed conveyancer's licence does not cover some related legal work, such as court proceedings or creating or varying a trust. Can you review a contract before an auction?

Yes. Send us the contract as soon as the agent provides it, well before auction day, and we will flag risks, special conditions and any clauses worth negotiating before you bid. If the auction is close, call (02) 9000 1408 to confirm whether we can review the contract before it.

Do you handle conveyancing across all of Sydney?

Yes. We're based in Norwest in the Hills District and act for clients across the Hills District (Castle Hill, Bella Vista, Kellyville, Rouse Hill, Norwest), the Parramatta corridor (Parramatta, Westmead, North Parramatta, Harris Park), Western Sydney, and Greater Sydney generally. NSW land dealings must be lodged electronically through PEXA or Sympli, so we can act for you wherever the property is in NSW.
